Your agreement with Stampwing
The service provider identified on this document operates Stampwing. These terms and the Acceptable Use Policy apply when you select “Create account” or “Complete account setup” after reviewing the signup notice. For an existing account, acceptance applies from that time onward. Authentication with an identity provider alone does not create a Stampwing workspace. If you act for an organization, you confirm that you have authority to bind it. Mandatory rights under applicable law remain in effect.
What the service does
Stampwing provides tools to queue and submit transactional email and inspect delivery events. Test mode simulates delivery and does not send real email. Live sending requires verification, approval, and configured infrastructure. Paying for a plan does not bypass these requirements.
A successful API request means the message was saved for processing. A submission attempt, provider acceptance, acceptance by a recipient’s mail server, inbox placement, and a person reading the email are different outcomes. We do not guarantee uninterrupted service, a particular delivery time, inbox placement, or that every message will be sent or received.
Interruptions and recovery
We will take reasonable care in operating the service and reasonable steps to investigate and address interruptions. Failures may involve Stampwing, hosting, databases, networks, email providers, or receiving servers. An interruption may delay sending or prevent it entirely.
Eligible queued messages can resume within their original deadlines. Expired messages are not submitted. Where a submission outcome is uncertain, automatic resending is disabled to reduce duplicates; investigation or provider feedback may be needed. Messages already submitted cannot reliably be recalled. A provider outage does not by itself establish force majeure.
If an interruption affects your messages, keep the message IDs, UTC timestamps, and observed delivery states. Check service status and contact the operator for help. Don’t include passwords, API keys, or message content unless it is needed and requested through an appropriate channel. This guidance does not shorten any period you have to exercise a legal right.
Your responsibilities
Protect your credentials, use domains and recipient information you are entitled to use, and follow the Acceptable Use Policy. Monitor delivery results and handle errors in your integration. Keep the same idempotency key and unchanged payload when retrying the same logical API request.
Maintain an appropriate alternative for communications whose failure or delay could cause serious harm or miss a legal deadline. Do not use Stampwing as the sole means of emergency notification or as a guarantee of legally effective notice. These responsibilities do not remove our obligations under applicable law.
Plans, charges, and cancellation
The price, currency, billing period, allowances, and applicable taxes are presented before you purchase a subscription. Paid subscriptions renew as disclosed at checkout until cancelled. Manage or cancel the subscription through the billing portal; contact the operator if it is unavailable. Paid overages require your separate choice of a spending cap.
An outbound usage unit is settled when the provider confirms acceptance. A message that fails or expires before provider acceptance releases its reserved usage. Receiving-server rejection after provider acceptance does not undo that submission. Retries and duplicate event notifications do not count twice for the same message.
Cancellation takes effect as disclosed at checkout or in your cancellation confirmation, subject to mandatory rights. Refunds and cancellation rights required by law remain available. Contact the operator to report a billing error or request an outage remedy.
Service commitments and remedies
No contractual uptime percentage or automatic service-credit schedule is included in these standard terms. Any separate service-level agreement must identify the covered service, measurement, exclusions, and remedies expressly. We may offer an appropriate credit or refund after reviewing an incident. This does not restrict remedies that cannot be excluded by law.
Liability
To the extent permitted by law, our aggregate liability arising from the service is limited to the greater of CAD 100 and the fees you paid to the operator for Stampwing during the 12 months preceding the event giving rise to the claim. To the same extent, we exclude liability for indirect losses, including lost profits to the extent they constitute indirect losses.
These limitations do not apply to material injury caused by intentional or gross fault, bodily or moral injury, or any liability or remedy that cannot lawfully be limited. They do not release the operator from the consequences of its own acts or those of its representatives where Québec consumer law prohibits that release. Nothing here removes the essential service obligations or authorizes an abusive clause.
Safety controls and account closure
We may hold or reject messages or restrict activity to investigate abuse, comply with law, or protect the service and recipients. Where appropriate, we will explain the restriction and a way to request review. Account closure stops new activity; already submitted messages cannot be recalled. Data handling and retention are described in the Privacy Notice. Mandatory notice and cancellation rights remain available.
Changes to these terms
The version you accept is preserved in your account. Material changes will be communicated before they apply, with renewed acceptance where appropriate and any legally required refusal or cancellation rights. We will not apply new terms retroactively to an earlier incident. Changes subject to Québec consumer law must follow that law.
Law, language, and questions
These terms are governed by Québec law and applicable Canadian federal law, subject to mandatory protections that apply to you. Nothing requires mandatory arbitration or waives access to courts or class proceedings where protected by law.
